Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of Eonrender’s website (https://www.eonrender.com/) and services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use our Services.

Intellectual Property

All content, including software, text, images, video, and design, is the property of Eonrender or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any materials without our explicit consent.

Client Content and Source Files

Clients retain full ownership of any raw materials or assets they provide for a project. Eonrender will only use client content for project execution and will not repurpose or disclose it unless explicitly authorized. Eonrender retains all rights to its internal project files, including Unreal Engine scene files, proprietary software, and licensed third-party assets. These files will not be shared with the client.

Upon a client's request, Eonrender will provide source files for any custom 3D models (e.g., furniture, props) created specifically for their project once full payment has been received.

Use of Services

You agree to use our Services for lawful purposes only. You may not:

• Violate any applicable law or regulation.
• Exploit, harm, or attempt to harm minors.
• Transmit spam, junk mail, or unauthorized solicitations.
• Impersonate Eonrender or any individual/entity.
• Engage in any activity that disrupts or harms Eonrender, its users, or its operations.

Confidentiality & Non-Disclosure

All client projects are confidential by default. Eonrender will not share, reuse, or disclose client models, designs, or project details to third parties without prior written consent. Clients may request a separate, mutually agreed-upon Non-Disclosure Agreement (NDA) for additional legal assurance.

Service Plans and Pricing

Specific pricing for all Services is available on our website’s pricing page and will be detailed in your project quote.

On-Demand 3D Team Plans The On-Demand 3D Team plan renews automatically unless canceled or paused. If paused, the remaining unused time carries over when resumed with no additional charges.

• Tier 1: 1 request at a time
• Tier 2: 2 requests at a time
• Tier 3: 3 requests at a time
• Tier 4: 4 requests at a time
• Enterprise: Custom pricing for greater flexibility or mixed services. Clients may upgrade to a higher tier at any time, but the upgraded tier will be billed for the full month and cannot be downgraded mid-cycle.

Pausing or Canceling Clients may pause their On-Demand 3D Team plan at any time, and any unused time will carry over when resumed. If a client cancels their On-Demand 3D Team plan, the service will continue until the end of the current billing cycle, after which no further charges will be applied.

Per Project Services

Per Project Services are priced based on project complexity, industry, and deliverables. A full deposit or payment is required before work begins, as specified in the project quote.

Revisions and Scope Changes The number of revisions included in a project is based on its size and complexity:

• Small project: 2 revisions
• Medium project: 3 revisions
• Large project: 4 revisions

A revision is a minor adjustment to the project, such as changes to textures, lighting, or small-scale asset placement, that does not alter the core creative brief or the architectural design. Any requested changes that fall outside of this definition are considered a change in the scope of work.

Changes to the project scope, including new architectural details, models, or design requirements not in the initial quote, will require a new agreement and may incur additional fees. Failure to provide all necessary project details upfront may also lead to project delays. All scope changes will automatically extend the project delivery timeline, and a revised delivery date will be provided.

Rush Services Rush fees apply for expedited work and are subject to availability. Rush service is only available for Per Project plans and must be requested separately.

Payment and Alternative Arrangements

If Eonrender offers additional services or value in exchange for a non-monetary return (e.g., a testimonial or usage license), the terms will be detailed in a separate, written agreement. If the client fails to provide the agreed-upon non-monetary return within 30 days of project completion, Eonrender reserves the right to invoice the client for the monetary value of the additional services provided.

Refund Policy

We do not offer refunds. If a technical issue within our direct control prevents the agreed-upon service from being delivered, we will assess the situation on a case-by-case basis. Our resolution may include providing a credit for future services. Eonrender is not responsible for and will not issue refunds or credits for any technical issues or delays resulting from third-party services, client-side hardware or software limitations, or external factors beyond our reasonable control.

Disclaimers & Limitations of Liability

Eonrender provides its Services "as is" without warranties of any kind, either express or implied. While we strive for accuracy, we do not guarantee that the final renderings will perfectly match the real-world finished product. We are not liable for any direct, indirect, or incidental damages arising from:

• Errors or inaccuracies in content.
• Service interruptions.
• Unauthorized access or data breaches.
• Any loss or damage resulting from Service use.

Force Majeure

Eonrender shall not be liable for any failure or delay in performance of its obligations due to events beyond its reasonable control, including acts of God, war, terrorism, strikes, labor disputes, material or hardware failure, power outages, internet service provider failures, or the death or incapacitation of key personnel.

Indemnification

You agree to indemnify and hold Eonrender and its affiliates harmless from any claims, damages, or legal fees resulting from your misuse of our Services.

Use of Work for Marketing

Eonrender may use work created for a client, including renderings, animations, or models, for its own marketing, promotional, and portfolio purposes, such as on its website, social media, or in advertisements. This is done only with the express written consent of the client. Clients may withhold this consent at their discretion. Eonrender will always seek permission before showcasing any work.

Dispute Resolution & Governing Law

In the event of any dispute arising from these Terms or your use of our Services, both parties agree to first attempt to resolve the matter informally by contacting Eonrender at hello@eonrender.com. If a resolution cannot be reached, any legal action or arbitration will be governed by the laws of the United States. We reserve the right to modify these Terms at any time, with notice provided for material changes.
